1. Data We Collect

Bykea collects information you provide directly to us, such as when you create or modify your account, request on-demand services, contact customer support, or otherwise communicate with Bykea. This information may include: name, identification card number, license number, nationality, address, telephone number, mobile number, bank details, gender, date of birth, marital status, resident status, education background, financial background, personal interests, email address and your occupation (“Personal Data” or “Personal Information”).

Additionally, through the signup process as well as for the adequate functioning of the app, we require file uploads from the user that include the following: image uploads of their relevant documents to prove identity, document uploads to prove required licensing and other relevant documents, image upload through 'selfie' to for identification purposes, and video uploads as well. We also process voice files in case support is required from customer services. All of this information is processed, stored and shared in accordance with the required laws as well as the company policies listed below. 

The provision of your Personal Data is voluntary. However if you do not provide Bykea your Personal Data, Bykea will not be able to process your Personal Data for the purposes outlined below.

If you are an agent, vendor, supplier or service provider, provision of your Personal Data is mandatory and failure to provide your Personal Data, may be a breach of laws or regulatory requirements, and may cause Bykea to be unable to engage you to provide services or products or issue payments to you for products or services provided.

When you use the Bykea Services (as defined in our Terms of Use), Bykea may collect information about you in relation to your location information (your geo-coordinates while the Bykea Application is being used or not) , Contacts Information (access and store names and contact information from your address book), transaction information (transaction details related to your use of Bykea Services), usage and preference information (information about how you and site visitors interact with Bykea Services, preferences expressed, and settings chosen, through the use of cookies, pixel tags, and similar technologies that create and maintain unique identifiers), electronic device information (including such as the hardware model, operating system, file names, unique device identifier, advertising identifiers, serial number, device motion information, and mobile network information), call and SMS data (call data, including the date and time of the call or SMS message, the parties’ phone numbers, and the content of the SMS message), log information (including server logs, which may include information like device IP address, access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and the third-party site or service).

The following Privacy Policy explains how we collect, use, transfer, disclose and protect your personally identifiable information obtained through our Application. Please review it carefully to make sure you understand our privacy practices.

Personal Data: Your demographic and other personally identifiable information (such as your name and email address) that you voluntarily give to us when choosing to participate in various activities related to the Application, such as booking a ride, customer support, or in our forums, liking posts, sending feedback, and responding to surveys. If you choose to share data about yourself via your profile, online chat, or other interactive areas of the Application, please be advised that all data you disclose in these areas will be accessible to the owners of the Application.

Derivative Data: The information our servers automatically collect when you access the Application, such as your native actions that are integral to the Application, including liking, replying, or resharing to a notification or post, as well as other interactions with the Application and other users via server log files.

Financial Data: Financial information, such as data related to your payment method (e.g. valid credit card number, card brand, expiration date) that we may collect when you use the online payment option for any of the services; booking, purchase, cancellation, exchange, or request information about our services from the Application. We store only very limited, if any, financial information that we collect. Otherwise, all financial information is stored by our payment processor and you are encouraged to review their privacy policy and contact them directly for responses to any questions.

Geo-Location Information: We may request access or permission to track location-based information from your mobile device, either continuously or while you are using the Application, to provide location-based services. If you wish to change your access or permissions, you may do so through your device’s settings.

Mobile Device Access: We may request access or permission to certain features from your mobile device, including your mobile device’s microphone, speaker, and GPS. If you wish to change your access or permissions, you may do so through your device’s settings.

Mobile Device Data:Device information such as the mobile device ID number, model, manufacturer, version of the operating system, phone number, country, location, preferred language, and any other data you choose to provide.

Push Notifications: We may request to send you Push-notifications regarding your account or the Application. If you wish to opt out of receiving these types of communications, you may turn them off through your device’s settings.

Data From Contests, Giveaways, and Surveys: Personal and other information you may provide when entering contests or giveaways and/or responding to surveys.

2. Using the Data We Collect

Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you via the application to:

    • Create and manage your account.
    • Fulfill and manage bookings, purchases, orders, payments, and other transactions related to the Application.
    • Communicate with you regarding your account, booking, purchase, or services opted for.
    • Enable user-to-business communications.
    • Administer promotions, sweepstakes, and contests.
    • Compile anonymous statistical data and analysis for use internally or with third parties.
    • Deliver targeted advertising, coupons, newsletters, and other information regarding promotions and the Application.
    • Generate a personal profile about you to make future visits to the Application more personalized.
    • Increase the efficiency and operation of the Application.
    • Monitor and analyze usage and trends to improve your experience with the Application.
    • Notify you of the updates to the Application.
    • Offer new products, services, features, and/or recommendations.
    • Perform other business activities as needed.
    • Prevent fraudulent transactions, monitor against theft or fraud, and protect against criminal activity.
    • Process payments and refunds.
    • Request feedback and contact you about your use of the Application.
    • Resolve disputes and troubleshoot problems.
    • Respond to product and customer service requests.
    • Solicit support for the Application.
    • Assist local law enforcement organizations in contingencies or accidents or criminal activities. 

3. Sharing the Data We Collect

Upon receipt of your order, we will share such information as your name, phone number, location, destination, geo-location, the items to be transported or bought with the Service Provider who accepts your request for Services. This information is required for the Service Providers to contact you, and/or find you and/or complete your order.

We also share the phone number of the contact person you have provided us with the Service Providers when you use the Application to find instant courier services.

You hereby agree and authorize us to transfer your Personal Information to the Service Providers as a part of the provision of the Services. While your personal information will automatically be deleted from the Service Provider’s mobile device after your use of the Service, it is possible that the Service Providers may be able to keep your data in their devices by any means. We are not responsible for this kind of data storage and you agree to defend, indemnify and hold us harmless and not liable for any misuse of your Personal Information by the Service Providers upon completion of the Service provided.

We may employ third party companies and individuals to facilitate or provide the Application and certain services on our behalf, to provide customer support, to provide geo-location information to our Service Providers, to perform website- related services (e.g. without limitation, maintenance services, database management, web analytics and improvement of our Website’s features) or to assist us in analyzing how our Service is used or to our professional advisors and external auditors, including legal advisors, financial advisors and consultants. These third parties only have access to your personal information in order to perform these tasks on our behalf and are contractually bound not to disclose or use it for any other purpose.

We do not share your Personal Information with any parties other than to the relevant Service Providers and the third party companies and individuals referred to in item 4 above, without your consent. However, we will disclose your Personal Information to the extent that this is legally required, or necessary to comply with statutory, regulatory and governmental requirements, or in the event of any dispute, or legal proceeding of any kind between you and us, or between you and other users with respect to, or in relation to the Services, or in the event of an emergency pertaining to your health and/or safety.

Your Personal Information may be transferred to, stored, used and processed in a jurisdiction other than Pakistan where our servers are located. You understand and consent to the transfer of your Personal Information out of Pakistan.

We do not sell, rent or lease your Personal Information to third parties.

Bykea may share the information it collects about you as described herein or as described at the time of collection or sharing – (a) with Service Providers to enable them to provide the transportation services to you including your name, photo (if you provide one), average rating given by Service Providers, and pickup and/or drop-off locations with Service Providers; with third parties to provide you a service you requested through a partnership or promotional offering made by a third party or Bykea; (b) with general public if you submit content in a public forum; with third parties with whom you choose to let us share information.

Bykea may also share your information its subsidiaries and affiliated entities, with vendors, consultants, marketing partners, and other service providers who need access to such information to carry out work on Bykea’s behalf; in response to a request for information by a competent authority if required by any applicable law, regulation, or legal process, with law enforcement officials, government authorities, or other third parties; in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.

We may collect and share geolocation data, including tower strength information, with telecommunication providers. Our trusted third-party telecommunication providers are bound by strict confidentiality agreements and utilize the data solely to enhance the quality and efficiency of our services.

We may share personally identifiable information with affiliated companies and network partners.

We freely use and disclose data in anonymous form, for example, in statistics or reports to our advertising customers. Even though we do not provide any personally identifiable information about you specifically to any advertising customers, they can occasionally find out information indirectly. For example, we frequently agree on target audiences for particular ads (for example, an advertiser may ask us to send certain information on infant safety products to parents with small children who may be particularly interested). If you choose to respond to such targeted advertisements, the advertiser may deduce that you are a member of the target audience to whom we sent the ad.

If we ever sell the Application or Bykea Services or substantial parts of our business, we may disclose your personally identifiable information to a (prospective) buyer on the condition that such buyer agrees to comply with this Privacy Policy.

Credit card and financing information may be provided to credit card and consumer financing companies as is required to process applications and transactions.

4. Deleting the Account & Data We Collect

You can request your account to be deleted by emailing your account details to [email protected].

You can also contact Bykea Customer Services (CS Team) on +92-307-1234567 and the CS Team can submit a request on your behalf.

Requests are processed within 7 working days of being received. Bykea will delete your account and delete or randomize your data where there are no legal or compliance issues preventing us from doing so.

5. Cookies and Advertising

A cookie is a small file which asks for permission to be placed on your electronic device’s memory. When you use out system, the file is added and the cookie helps us to analyze web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application or mobile apps can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.

Bykea may use traffic log cookies to identify which pages are being used. This helps us analyze data about mobile app or webpage traffic and improve our system in order to tailor it to our user needs. Bykea may only use this information for statistical analysis purposes.

You cannot choose to decline cookies.

6. Retaining the Data We Collect

We will retain your information until you cancel your account in the Application.

  • Children’s Privacy: Our services are intended for users who are of legal age. We do not knowingly collect personal information from individuals under the age of 18 without parental consent.

  • Vulnerability Reporting: We value the contribution of white hat hackers to enhance the security of our platform. If you identify a vulnerability or security issue, we invite you to participate in our Vulnerability Rewards Program (VRP)/Bug Bounty Program. You can submit your findings through the submission form at Bykea Security. We offer rewards as a token of appreciation for your efforts in helping us maintain the security of our user data.

While we diligently implement these security measures, it’s important to recognize that no method of data transmission or storage can guarantee absolute invulnerability. However, please be assured that we are unwaveringly committed to continuously enhancing our security practices to the best of our abilities. In line with this commitment, we would like to emphasize that Bykea shall not be held liable for any unforeseen security breaches or incidents that may occur despite our earnest efforts to protect your information. 8. Changes to this Privacy Policy

9. Notice

Bykea may give notice by means of a general notice on the Bykea Services, electronic mail to your email address in your Account, or by written communication sent to your address as set forth in your Account. You may give notice to Bykea by written communication to Bykea’s corporate address at BYKEA TECHNOLOGIES PRIVATE LIMITED, 60-C Khayaban e Ittehad, DHA 6, Karachi 75500.



10. Others

You shall not assign or transfer these Bykea Terms and Conditions in whole or in part without Bykea’s prior written approval. You give your approval to Bykea for it to assign or transfer these Bykea Terms and Conditions in whole or in part, including to: (i) a subsidiary or affiliate; (ii) an acquirer of Bykea’s equity, business or assets; or (iii) a successor by merger. No joint venture, partnership, employment or agency relationship exists between you, Bykea or any Third Party Service Provider as a result of the contract between you and Bykea or use of the Bykea Services.

If any provision of these Bykea Terms and Conditions is held to be illegal, invalid or unenforceable, in whole or in part, under any law, such provision or part thereof shall to that extent be deemed not to form part of these Bykea Terms and Conditions but the legality, validity and enforceability of the other provisions in these Bykea Terms and Conditions shall not be affected. In that event, the parties shall replace the illegal, invalid or unenforceable provision or part thereof with a provision or part thereof that is legal, valid and enforceable and that has, to the greatest extent possible, a similar effect as the illegal, invalid or unenforceable provision or part thereof, given the contents and purpose of these Bykea Terms and Conditions. These Bykea Terms and Conditions constitute the entire agreement and understanding of the parties with respect to its subject matter and replaces and supersedes all prior or contemporaneous agreements or undertakings regarding such subject matter. In these Bykea Terms and Conditions, the words “including” and “include” mean “including, but not limited to.”

Bykea reserves the right to modify, terminate or suspend the Bykea Services/Application at any time without prior notice due to any changes in internal policy or the applicable laws or any breach of these Bykea Terms and Conditions by you or for any reason whatsoever. You may terminate your account by submitting a request to Bykea. You shall remain responsible for all activities that occurred prior to termination of your account. Further, Bykea shall also reserve the right to suspend your account without any notice to you in the event Bykea suspects that your account is being used in a manner so as to cause nuisance or prejudice to Bykea or any other persons.

Bykea will not be liable for any failure to provide the Bykea Services or perform any obligations, if the performance is prevented, hindered or delayed as a cause of any event arising due to any cause beyond the reasonable control of Bykea and in such case its obligations shall be suspended for so long as the event continues.

Governing Law and Jurisdiction. This privacy policy is governed by and to be construed under the laws of the Islamic Republic of Pakistan. Any and all disputes arising from this privacy policy shall be governed by the exclusive jurisdiction of the Courts in Karachi.

By using the Application, you acknowledge that you have read and understood this Privacy Policy and the Terms of Use and agree and consent to the use, practice, processing and transfer of your personal data by us as described in this Privacy Policy.

You also represent that you have the right to share all the information you have provided to us and to give us the right to use and share the information with the Service Providers.

12. Unsubscribe from email database

For email subscription, we follow the opt in and out policy. If you would like to stop receiving emails from Bykea, please click unsubscribe included in every e-mail.
